general trade conditions

clause 1: object

The general trade conditions described below govern the rights and obligations of Société Coopérative Utilitaire de Distribution Solidaire and its member in connection with the sale of organic, natural, biodynamic, fair trade foods, beverages, flowers, cosmetics, essential oils and essences that do not contain harmful substances. Any service provided by Société Coopérative Utilitaire de Distribution Solidaire therefore implies the unconditional acceptance by the buyer of these general conditions of sale.

clause 2: prices

The prices of the goods sold are the prices valid on the date of acceptance of the order. They are stated in pounds and are calculated with the respective VAT rate. Accordingly, they are increased by the transport costs applicable on the day of the order. The Société Coopérative Utilitaire de Distribution Solidaire reserves the right to change its prices at any time. However, it undertakes to invoice the ordered goods at the prices indicated when registering the order.

clause 3: discounts and rebates

The prices offered include discounts and rebates that the Société Coopérative Utilitaire de Distribution Solidaire could grant in view of its results or the assumption of certain services by the buyer.

clause 4: discount

No discount is granted for advance payment.

clause 5: payment method

Payment for orders is made by credit card.

clause 6: delivery

The delivery is made:

  • either by direct delivery of the goods to the buyer ;
  • or by sending a notice of availability in the store for the attention of the buyer ;
  • or by mail.

The delivery time indicated when registering the order is only indicative and is not guaranteed in any way.

As a result, any reasonable delay in the delivery of the Products may not give rise to a claim in favor of the member:

  • the awarding of damages ;
  • the cancellation of the order.

The transport risk is fully borne by the member. In the event of missing goods or goods damaged during transport, the member must note all necessary reservations on the order form upon receipt of the goods. These reservations must also be confirmed in writing by registered mail with return receipt within five days of delivery.

clause 7: force majeure

The Société Coopérative Utilitaire de Distribution Solidaire cannot be held liable if the non-performance or late performance of any of its obligations described in these General Terms and Conditions is due to a case of force majeure. In this context, force majeure is understood to mean any external, unforeseeable and irresistible event within the meaning of Article 1148 of the French Civil Code.

clause 8: jurisdiction

All disputes relating to the interpretation and execution of these general trade conditions shall be governed by French law.

If no amicable settlement can be reached, the dispute shall be brought before the Commercial Court of Antibes.
